Insurance

All agreements must obtain insurance that is equal to or greater than the following MBTA insurance requirement threshold amounts:

Commercial General LiabilityThreshold
Personal Injury, bodily injury and property damageNot less than one million dollars ($1,000,000)
Per occurrenceNot less than three million dollars ($3,000,000)
Umbrella CoverageNot less than ten million dollars ($10,000,000)
Automobile LiabilityThreshold
All owned, non-owned, hired, rented or leased vehicles of licensee and its consultants and contractors used in the permitted license activitiesNot less than one million dollars ($1,000,000)
Property Damage
Not less than the full replacement cost from time to time of the Premises, insuring such improvements against fire and other hazards customarily covered by so called “all-risk” insurance.
Worker’s Compensation
Not less than those required by the Massachusetts General Laws, Chapter 152, as amended.
Railroad Protective (if applicable)Threshold
Per occurrenceNot less than five million ($5,000,000)
Aggregate combined bodily injury and property damageNot less than ten million ($10,000,000)
Asbestos Abatement Liability (if applicable)Threshold
Per lossNot less than two million dollars ($2,000,000)
In aggregateNot less than two million dollars ($2,000,000)
Transportation Pollution CoverageNot less than two million dollars ($2,000,000)
Contractor’s Pollution Liability (if applicable)Threshold
Per occurrenceNot less than two million dollars ($2,000,000)

Hazardous Waste Haulers InsuranceNot less than two million dollars ($2,000,000)

Insurance certificates must note the MBTA and all applicable railroad companies as additional insureds. Certificates will not be accepted if the thresholds do not meet the MBTA required threshold amounts and/or the MBTA and applicable railroad companies are not listed as additional insureds.
